It is important to thoroughly investigate any claim of harassment, discrimination, or violations of law or company policy. It is also important to obtain witness statements during the course of your investigation that can be used later on in a court of law if necessary. To this end, any witness statement, in order to be used in lieu of testimony, must contain a declaration under oath, pursuant to the penalty of perjury. You may also consider having the statement notarized. You should also consider consulting an attorney prior to conducting any investigation or interview. Be sure to obtain witness statements of employees while they are still under your employ. Very often, an employee will view the facts related to a claim differently once they leave your company. Make sure to place the statement in a work product protected file created in anticipation of possible litigation. The file should be marked Confidential and not be placed with the employee's personnel file. If you are ever notified of an actual claim being filed you should immediately forward the work product file to your attorneys. Make sure that the employee's understanding on the following subject areas is set forth: background with the alleged violator and/or claimant; background with any other essential witnesses; physical proximity to the alleged incidences; understanding as to claimant's concerns; awareness of facts, documents or persons related to the claimant's concerns; and additional facts not originally addressed by the claimant, including the facts, documents and persons related to the additional facts. You will find on the next page all the steps to write a good witness statement form. It records the witness's identity, their description of what happened, the time and location of the incident, and a signed declaration that the account is accurate. It is used in workplace investigations, insurance claims, and legal proceedings as a contemporaneous record of observed facts.

When should a witness statement be collected?","Collect a witness statement as soon as possible after the incident — ideally on the same day. Memory fades quickly and can be influenced by conversations with other witnesses, so an early statement is more reliable and carries more weight in insurance and legal contexts. Waiting more than 48 hours significantly increases the risk of detail loss or contamination.

Does a witness statement need to be notarized?","In most workplace and insurance contexts, notarization is not required. A signed declaration of accuracy, dated on the day the statement was completed, is typically sufficient. If the statement will be used as formal evidence in court proceedings, consult a lawyer about whether a sworn affidavit or notarized form is required in your jurisdiction.

Can a witness statement be used in court?","A written witness statement can be used to support a case, refresh a witness's memory before testifying, or establish what a witness said at the time of the incident. Admissibility depends on jurisdiction and the rules of evidence in the relevant court — hearsay rules, in particular, affect how written statements are treated. Consider legal advice if the statement is intended for formal litigation.

What is the difference between a witness statement and an incident report?","An incident report is typically completed by the person responsible for recording the event — an employer, safety officer, or manager — and covers the full facts of the incident from an administrative perspective. A witness statement is completed by or on behalf of an individual who directly observed the incident and captures their personal, firsthand account. Both documents are often collected together and complement each other.

Should the witness write their own statement or have someone else record it?","Whenever possible, the witness should write their own statement in their own words. If the witness is unable to write — due to injury, language barriers, or other reasons — a collector can transcribe the account verbatim and then have the witness review, correct, and sign it. Avoid summarizing or paraphrasing, as this substitutes the collector's words for the witness's account.

How many witnesses should complete a statement for a single incident?","Collect a statement from every person who directly observed the incident, regardless of how similar their accounts appear to be. Independent corroboration from multiple witnesses strengthens the overall record, and small differences between accounts can be as informative as similarities. Collecting only one statement when multiple witnesses were present is a common investigation gap that is difficult to close later.
",[403,407,411,415
"Construction and Trades","industry-construction","Witness statements for on-site accidents are required by OSHA recordkeeping rules and support workers' compensation and liability claims.
"Healthcare","industry-healthtech","Staff witness statements document patient incidents, near-misses, and workplace injuries as part of mandatory incident reporting and risk management protocols.
"Retail and Hospitality","industry-retail","Customer or employee witness accounts of slip-and-fall or premises liability incidents are central to insurance claims and litigation defense.
"Professional Services","industry-professional-services","HR investigations into workplace misconduct, harassment, or discrimination rely on structured witness statements to document corroborating or conflicting accounts.",[420,423,426,430
"incident-report-form-D13393","An incident report is completed by a manager or safety officer and summarizes the full facts of an event from an administrative viewpoint. The completed form is signed by the witness to confirm the account is accurate and true to the best of their knowledge. Organizations use witness statements to support workplace investigations, process insurance claims, establish facts for regulatory reporting, and preserve evidence before memories fade or details become disputed.

Why You Need This Document

Without a structured form, witness accounts collected verbally or in informal notes are easily challenged — details vary between retellings, key fields like time and location go unrecorded, and there is no signed declaration tying the witness to their account. In an insurance claim, a poorly documented statement can slow processing or reduce a payout. In litigation, an unsigned or undated account may be inadmissible. Collecting statements late — even 48 hours after an incident — measurably reduces reliability and gives opposing parties grounds to question the record. This template gives you a consistent, complete format to deploy immediately after any incident, so every statement you collect is dated, signed, and detailed enough to hold up under scrutiny.

",1778773584930]
